Poeler Appartement Service GmbH – Terms and Conditions of Lease

 

  1. We conclude this lease in the name and with the authority of the owner. The rental agreement is concluded by clicking on “Payable” at the end of the correctly       filled-in booking form and then displaying a confirmation e-mail. We ourselves are only the intermediary and authorised by the owner to make and receive, on  his behalf and on his behalf, all appropriate declarations in connection with the rental relationship and to accept your payments. This means that we are not organizers within the meaning of §651a, Abs 1 BGB. The owner is solely liable for the fulfillment of the landlord’s obligations, not us as intermediary.
  2. You can cancel your stay with PAS free of charge up to 46 days before arrival. If you cancel the trip or if you do not make the booking for reasons beyond the control of PAS or the owner, a reasonable compensation is to be paid instead of the rental price. Account shall be taken of normally saved expenses and other uses normally possible. The flat-rate right to cancellation fees is: from the 45th day before departure 100%. You are free to prove that no or substantially lower costs have been incurred in connection with the cancellation. It is recommended to take out travel cancellation insurance. In case of no-show or cancellation by the tenant is additionally a lump sum to cover the additional expenses incurred in the amount of EUR 79,- plus VAT. VAT has to be paid unless the tenant proves that the corresponding expenditure has not been incurred at all or only substantially lower than the lump sum.
  3. Unless otherwise agreed, you will receive the keys for the rental object in the PAS office; outside office hours by arrangement with PAS. The rental object can be occupied from 4:00 p.m. All keys must be returned to PAS by 10:00 a.m. at the end of the rental period, unless otherwise agreed. If not all the keys are returned, you are threatened with substantial claims for damages, for example because of the necessary installation of new door locks.
  4. Unless otherwise agreed, bedding for babies and towels, cot and high chair are not provided. A subsequent order of towels is possible up to 5 days beforearrival for the currently valid fee. The final cleaning printed on the front is mandatory and not an optional service.
  5. Please notify us of any damage or other defects in the rented property and inventory, including the state of cleaning, within 24 hours of your arrival so that we can remedy the situation. Otherwise we assume that you have found the rental object to your complete satisfaction. Many domiciles are in idyllic natural locations and close to the sea, which is why insects, bird droppings, leaves, salt deposits or similar can naturally occur on balconies/patios and on the windows. After each departure, the balconies and terraces are cleaned. We are happy to offer you an intermediate cleaning during your stay for a fee.

  6.  The accommodation of additional persons is only permitted up to the number of sleeping places mentioned on the front. Every additional person is to be notified PAS immediately and to be compensated with an additional rent of EUR 25,- per day started. Otherwise, the rented object may not be rented to third parties or otherwise transferred to third parties for a fee. If you bring more than the registered animal (s) in an object where pets are allowed, the currently valid animal surcharges must be paid per animal.
  7. Pets may not be included in the rental property unless expressly permitted in the address description (then only for a valid fee per day per animal). We urge you to adhere to this requirement, as the rental object is partly rented to allergy sufferers, to whom we have expressly assured that no pets were present in the rental object. In the event of an infringement, you are threatened with substantial claims for damages.
  8. The house and bathing regulations laid out in the rental object form part of this rental agreement. Please observe the relevant rules of conduct so that you and our other holiday guests can enjoy a relaxing holiday.
  9. The keys for the rental object must be handed in at the PAS office no later than 10:00 a. m. on the day of departure. Please do not hesitate to meet this deadline, as new holiday guests may be getting the rental property on the same day and we must carry out a thorough cleaning of the rental property beforehand. In the event of a late handing over of the keys, we must reserve the right to assert an additional daily rent and any claims for damages due to the late handing over of the rented object to the following holiday guests.
  10. The keys for the rental property must be handed in to the PAS office by 10:00 a.m. on the day of departure, unless otherwise agreed. Please be sure to keep this appointment, as new holiday guests may move into the rental property on the same day and we must first clean the rental property thoroughly. In the event of a late handover of the key, we must reserve the right to assert an additional daily rent and any claims for damages due to the late transfer of the rental object to the following holiday guests.
  11. Windows contaminated by birds or seawater are cleaned only by order and at the expense of the owners. If a tenant wishes an interim cleaning, he has to pay for it. Insects and spiders are increasing on the island and do not entitle the tenant to make rent reductions.
  12. If you have booked a rental property with lawn, we mow it regularly. This takes place on working days between 9. 00h and 17. 00h while observing the midday rest.
  13. We are happy to be at your disposal in absolute emergencies. Should a PAS employee be requested outside our opening hours for the following services: setting up of TVs, Wi-Fi/Internet, defective/beeping smoke detectors, problems opening doors, requesting unbooked linen, incorrect arrival day, we will charge you a flat rate of €50. 00 for our service. BAR is payable at the emergency service.
  14. We expressly point out that charging electric or hybrid cars is not permitted at the power of the house! Please use the corresponding columns. The currently charged energy lump sum applies exclusively to the consumption of electricity and gas for the energy supply of the rented property. The withdrawal of electricity for charging e-cars is strictly prohibited. The wiring network of the objects is not designed for this. Damage to the electrical lines and fire damage cannot be excluded during such charging operations. The management of PAS is responsible for reporting infringements to the owner.
  15. Additional agreements, modifications and additions to the contract shall be agreed in writing for reasons of proof.
  16. Should individual provisions in these terms and conditions of lease be or become ineffective, the contract shall remain in effect. The ineffective regulation is to be replaced by statutory regulations. The place of jurisdiction for full traders, for persons who do not have a general place of jurisdiction in Germany, and for persons who have moved their domicile or habitual residence abroad after the conclusion of the contract, as well as for passive litigation, is the registered office of PAS.
  17. In the case of properties with Internet & WLAN, the landlord provides the tenant with the use of the internet connection free of charge. Visiting websites with illegal content is excluded. No legal claim to functionality can be derived from making it available free of charge. The tenant and the landlord agree that any costs arising from a use contrary to the contract or use contrary to the aforementioned framework are to be borne by the tenant. Furthermore, the tenant and the landlord agree that the tenant must inform the landlord accordingly if he knows or even suspects that a paid or illegal website has been visited or opened. The sending of messages of illegal, violent or pornographic content via the connection of the landlord is prohibited. The tenant is liable for any damage.
